wedding videography service level agreement ::
I. Introduction
This document serves as a guideline to define the responsibilities and obligations of both The Production Haus and the corresponding client requesting Wedding Videography service. Throughout this document, references are made to primarily two parties, The Production Haus, LLC and the client (you). The Production Haus (“we” or “us”) is the business responsible for executing the Wedding Videography service, while the client (“you”) is the recipient of the Wedding Videography service. The Production Haus reserves the right to revise this document as necessary at any time given the appropriate notice is made to all applicable clients involved in pending agreements for Wedding Videography service. If and when changes are made to this document, the changes will be communicated to clients primarily through the use of e-mail. If and when changes are made to this document, all applicable clients will have the opportunity to decline the revisions and terminate the Wedding Videography service. In such a case, any payments for work not already completed by The Production Haus will be refunded to the client (including deposits and any other payments). This document is legally binding with your explicit agreement signified by checking the specified box on the online Wedding Videography Order Form.
II. Terms of Service
After submitting an order for Wedding Videography service, you are responsible for sending a minimum $100.00 deposit to The Production Haus to officially reserve your requested wedding date. You should send the deposit to:
The Production Haus 112 Renford Road Ball Ground, GA 30107
Please note that a minimum of $100.00 is required to officially reserve your requested wedding date (any amount greater than $100.00 is also acceptable). After The Production Haus receives your deposit, we will confirm to you via e-mail that we have received your deposit to officially reserve your wedding date. Until The Production Haus receives your deposit, we are not obligated in any way to reserve or hold your wedding date in any way. The deposit is classified as non-refundable, and serves as a commitment on behalf of the client to make the final payment of the remaining balance due on or prior to your requested wedding date. The party responsible for the final payment of the remaining balance due is that which is supplied to The Production Haus listed under “Billing Information” when the client initially orders Wedding Videography service by completing the online order form. If the billing party fails to make the final payment of the remaining balance due, the responsibility of the final payment is transferred to the Bride (or the Bride’s immediate family) as supplied through the online order form. If the billing party and Bride fail to make the final payment of the remaining balance due, the responsibility of the final payment is transferred to the Groom (or the Groom’s immediate family) as supplied through the online order form.
If the client requests a voluntary cancellation of Wedding Videography service, The Production Haus is not responsible for refunding the initial deposit. Note that the deposit is only fully refundable in the case where the Wedding Videography Service Level Agreement is revised, and the client chooses to decline the revisions and terminate the Wedding Videography service.
The payment schedule for Wedding Videography service is as follows: 1) A $100.00 deposit is required to reserve your wedding date. Any transportation expenses are also due with the deposit to reserve your wedding date. 2) The remaining balance is due in full on or prior to your wedding date (applies to cash and check payments). You can make payments towards the balance in any amount and frequency (applies to cash and check payments). If you wish to pay by credit card, the entire remaining balance must be paid in a single transaction (minus any existing payments). If the remaining balance is not paid on or before your wedding date, The Production Haus is not obligated in any way to perform the actual service. If you plan on paying the final balance with a credit card, the payment must be made within 15 days prior to your wedding date (or sooner). There is a 15 day grace period that begins immediately after your requested wedding date before late fees are applied to any remaining balance due. Late fees are calculated according to the following guidelines: 1) Any balance remaining from 1-14 days late is subject to an 18% charge of the remaining balance. 2) Any balance remaining from 15-30 days late is subject to a 10% charge of the remaining balance. 3) Any balance remaining from 31-60 days late is subject to an 8% charge of the remaining balance. Once late fees are charged, they are considered part of the original balance and therefore subject to additional late fees if the balance remains unpaid. Any remaining balance must be paid in full within a maximum of 60 days after your wedding date before alternate methods of collection are pursued. To avoid late fees be sure to pay your full balance on or before your wedding date or within the 15 day grace period starting immediately after your wedding date.
While performing the service requested, The Production Haus is not responsible for any uncontrollable events or circumstances affecting adverse outcomes for the client such as, but not limited to: equipment failure and/or malfunction, transportation delays, and venue or on-site facility limitations. In the event of uncontrollable circumstances directly preventing The Production Haus from producing the Wedding Videography service according to the specifications agreed to, The Production Haus will discount the final payment due up to 100% of the order total (including the deposit) if deemed necessary. While performing the service requested, if the wedding ceremony exceeds 90 minutes in length (from official start to end) or the reception exceeds 4 hours (from the end of the wedding ceremony to the departure of the groom and bride), the client will incur additional time billed at a rate of $75.00 per hour. Note that the included 4 hours of reception coverage begins immediately after the wedding ceremony. If the total on-site service time extends beyond 8 hours (from beginning of setup to end of reception), any time beyond 8 hours will be billed at overtime, which is time and a half ($112.50 per hour).
For any destination exceeding 25 miles from our sales office located in Alpharetta, Georgia (including but not limited to ceremony or reception venues), a transportation fee of $0.59 per mile is charged for the complete round trip (to and from). Other transportation charges include any additional expenses due to the necessity of an overnight stay (hotel, meals, etc.). If your order requires transportation fees, the transportation fees are due in full along with the deposit in order to officially reserve your wedding date.
The Production Haus is responsible for producing and initiating delivery of the service requested along with any options or additional specifications supplied. Furthermore, The Production Haus holds the full discretion of how the service should be produced and completed. Specifically, Justin Pepple is to be designated as the lead producer throughout any and all services performed. While Justin Pepple may not be able to physically be present the entire duration of the services performed, all employees or sub-contractors employed by The Production Haus will adhere to the standards set forth by Justin Pepple. Furthermore, all outgoing products and/or work shall be approved by Justin Pepple before delivery to the client. In the rare event that Justin Pepple is unable to serve in the capacity of the lead producer, a fully comparable substitute will be provided. If the comparable substitute is unable to perform the service per the specifications supplied, the client will be refunded correspondingly up to 100% of the order total (including the deposit). The completion and initiated delivery of the service by The Production Haus is due within a maximum of 60 days from the specified wedding date. The Production Haus is not responsible for the actual physical delivery process of the completed service. When The Production Haus has completed the service and initiated the delivery process, the delivery agent (i.e. U.S. Postal Service) assumes responsibility for the proper delivery of the completed service. However, if the delivery agent fails to deliver the completed service within 14 days, The Production Haus will re-create the completed service and re-initiate the delivery to whatever means necessary so that the client receives the completed service. When the client receives the completed service, an invoice will be included in the delivery containing any remaining balance due. The invoice total is simply the total for the actual services rendered minus the initial deposit and any other payments (delivery is complimentary). In the event a positive balance occurs, The Production Haus will pay the client the corresponding amount to reduce the account to $0.00 (when the actual rendered service differs from the paid service).
The Production Haus is required to archive all applicable content related to a particular service performed for up to 2 years after the billing date. After 2 years, The Production Haus is no longer required to archive content. Therefore, if the client desires additional copies of the finished DVD, the client should request such within 2 years after the billing date.
